The U.S. Chamber Institute for Legal Reform released its 2005 state liability rankings on March 8, 2005. The report supports continued civil justice reform efforts. This is the fourth year for the national survey of senior corporate attorneys from around the country, conducted by Harris Interactive.

The best ranked states are Delaware, Nebraska, North Dakota, Virginia and Iowa. North Dakota replaces Idaho in the top five. The bottom-ranked states for 2005 are Mississippi, West Virginia, Alabama, Louisiana and Illinois. Illinois replaces California in the worst 10 percent of states. In addition, three Illinois counties are in the list of local jurisdictions with the worst legal environments for businesses: Cook, Madison, and St. Clair counties. St. Clair County is located next to Madison County in southern Illinois.

The survey indicates that about 90 percent of interviewed corporate attorneys familiar with the recent legislation expect improvements in Texas and over 95 percent expect improvements in Mississippi, following recent enactment of significant tort reforms in those states. At the same time, Illinois and Florida are significant among states dropping in the survey, with Illinois down 12 spots in the last three years to number 46, and Florida down nine spots in the last three years to number 42.

Over 80 percent of senior in-house counsel say that the litigation environment in a state could affect important business decisions at their company, including where to locate or do business.

AIG Loses Chief Executive Officer and delays filing 10-K annual report

Chief Executive of AIG (American International Group Inc.) Maurice R. Greenberg stepped down as investigations continue into the world’s largest insurer’s practices.

Filing of their Form 10-K annual report with U.S. Securities and Exchange Commission has also been delayed due to management changes and an internal review of accounting practices. The ongoing review was prompted by “previously announced regulatory inquiries,” said AIG.

The Spam Epidemic

As anyone who has ever opened their inbox and had to dig through page after page of unwanted emails will tell you, the Spam epidemic is a huge problem. What is amazing is that the old saying of “20% of people in [insert your favorite organization here] perform 80% of the work” is even more skewed when discussing spam. It is estimated that a core group of “Spam Kings” that number less than 1,000 are responsible for almost 90% of all the spam sent around the world.

How is that possible? It is in large part due to the advent of broadband internet access that is now available in residential areas. Inexpensive high-speed access has enabled Spammers to raise up an army of “zombie” spam-generating home computers, while their owners are completely unaware that their slick, high-powered PCs are being used for more than just their own work and enjoyment.

E & Y Begins
Annual Audit

Representatives of Ernst & Young arrived at the Home Office on March 14th to begin work on their annual audit of American Mining Insurance Company and CGH Insurance Group. Auditors will be in the Home Office for approximately three weeks to review company records, test data, and verify assets for the year 2004.

Audited financial statements of American Mining Insurance Company are filed annually with various state insurance departments on June 1st.

Exam Continues

The Alabama Insurance Department examination of American Mining Insurance Company is still in progress. All insurance companies are required to submit to an examination by their home state every three to five years. The exam of AMIC covers the years 2000, 2001, 2002 and 2003. Since the exam covers four years of operations it takes many months to complete. A market conduct audit is also part of the exam. Market conducts involving verifying that agents are properly licensed, checking to determine if the Company is using approved rates and policy forms and investigation of complaints (if any) made against the Company.
